Privacy policy
Article 1: General
- These Terms and Conditions, along with the Privacy Statement, govern the use of Coolenator Products.
- If Coolenator integrates third-party services or applications (such as Facebook or Google), the Terms and Conditions, privacy, and/or cookie policy of the third party may also apply. Coolenator is not responsible for third-party services, Terms and Conditions, or privacy and cookie policies. The Consumer must approve these separately. In case of contradiction, these Coolenator Terms and Conditions and Privacy Statement will prevail.
- Any deviation from these Terms and Conditions is only valid if explicitly agreed upon in writing by Coolenator.
- If any provision in these Terms and Conditions is null or void, the remaining provisions will remain in full force. Coolenator and the Consumer will consult to replace such provisions while maintaining the original intent.
- Coolenator reserves the right to modify these Terms and Conditions at any time. The Consumer is responsible for reviewing any updates.
- Coolenator does not provide guarantees unless explicitly stated in these Terms and Conditions, agreed upon in writing, or required by law.
Article 2: Definitions
- The following definitions apply:
- Consumer: The natural person who purchases a Coolenator product.
- Terms and Conditions: The most recent version of Coolenator’s Terms and Conditions of Use.
- Privacy Statement: The most recent version of the Coolenator Privacy Statement, applicable to data processing, available via the website.
- Parties: Coolenator and the Consumer collectively.
- Products: The physical products sold by Coolenator via its webshop and resellers.
- Coolenator: Van Noord Beheer B.V., located at Nijverheidsweg 17L, 1074VM, Mijdrecht, registered under Chamber of Commerce number: 34135819.
Article 3: Product Guarantees and Liability
- The Consumer is entitled to statutory warranty rights. Coolenator provides a 30 day guarantee on its products for normal use. The guarantee period starts upon receipt of the product.
- The guarantee does not apply if the product has been damaged due to:
a. Intentional misuse or negligence by the Consumer.
b. Improper use or lack of maintenance.
c. Normal wear and tear.
d. Failure to follow instructions for use.
e. Unauthorized repair by third parties.
f. Extreme conditions such as storms, floods, fire, or other external factors.
g. Opening or dismantling of the product. - Coolenator’s maximum liability is limited to the price paid by the Consumer or, where applicable, the amount covered by Coolenator’s liability insurance.
- Coolenator is only liable for direct damages. Indirect damages such as lost income, lost profits, data loss, and reputational harm are excluded.
- Except where prohibited by law, Coolenator excludes all implied warranties regarding the product’s fitness for a particular purpose.
- If a defective product is covered under warranty, Coolenator may choose to repair or replace the product with new or properly functioning components.
Article 4: Product Availability, Pricing & Orders
- Product Descriptions: Coolenator strives to provide accurate product descriptions and images but does not warrant that all content is entirely accurate, complete, or error-free. If a product does not match its description, the sole remedy is to return it in unused condition.
- Availability: All products are subject to availability. Coolenator reserves the right to discontinue or modify any product at any time without prior notice.
- Pricing: Prices may change without prior notice. Orders placed before a price adjustment will not be affected.
Article 5: Intellectual Property & Use Restrictions
- Intellectual Property Rights: All website content, including text, images, logos, digital downloads, and software, is the property of Coolenator or its content providers. Unauthorized use or reproduction is strictly prohibited.

Prohibited Uses: Consumers may not use Coolenator’s website or content for:
- Illegal activities.
- Encouraging unlawful acts.
- Violating local or international regulations.
- Transmitting malicious software or spam.
Article 6: Customer Feedback & Submissions
- If a Consumer submits ideas, suggestions, proposals, or other materials (online, via email, or otherwise), Coolenator reserves the right to use such submissions without restriction, including for promotional and commercial purposes.
Article 7: Order Cancellation, Returns & Refunds
- Consumers have a 14-day return period from receipt of the product, provided it remains unused and in original packaging.
- Returns must be approved by Coolenator before shipping.
- Refunds (excluding shipping fees) will be processed within 14 days after receiving and inspecting the returned item.
Article 8: Indemnification
- Consumers agree to indemnify and hold harmless Coolenator and its affiliates from any claims, losses, or liabilities arising from a breach of these Terms and Conditions.
Article 9: Termination of Services
- Coolenator reserves the right to suspend or terminate accounts or services if the Consumer violates these Terms and Conditions.
Article 10: Governing Law & Disputes
- These Terms and Conditions are governed by Dutch law.
- Any disputes shall be exclusively resolved in the Court of Lelystad, the Netherlands.
Final Notes
These Terms and Conditions form a legally binding agreement between Coolenator and the Consumer. By purchasing or using Coolenator products, the Consumer agrees to these terms.
